Welcome to ChessVC. These Terms of Service (“Terms”) form a binding agreement between you and the operator of ChessVC (“ChessVC”, “we”, “us”) governing your access to and use of our website, applications, and related services (collectively, the “Service”).
By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
This document is provided for general information and does not constitute legal advice.
1. Eligibility and authority
You must be able to form a legally binding contract in your jurisdiction to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.
If you are a minor, you may use the Service only with the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf.
2. Accounts and security
You must provide accurate registration information and keep it up to date where the Service allows. You are responsible for safeguarding your credentials and for activity under your account. Notify us promptly via Support if you suspect unauthorized access.
We may refuse registration, require verification, or disable accounts that violate these Terms or present security risk.
3. The Service
ChessVC provides online chess gameplay and related social features, which may include voice communications, matchmaking, ratings, invites, supporter perks, and other functionality we make available from time to time. Features may change, be suspended, or discontinued.
The Service is intended for personal, non-commercial entertainment unless we expressly agree otherwise in writing.
4. Voice communications and user interactions
Voice features may route audio between participants using realtime internet technologies. You consent to the technical processing needed to connect sessions as described in our Privacy Policy.
You may encounter content or behavior from other users that you find objectionable. While we may provide moderation tools (such as mute or block), we do not guarantee monitoring or supervision of communications. You use voice and chat features at your own risk.
5. Acceptable use
You agree not to:
- Violate applicable laws or regulations;
- Harass, threaten, defame, discriminate against, or harm others, or encourage self-harm or violence;
- Share unlawful content, sexually explicit content involving minors, non-consensual intimate imagery, malware, or instructions intended to facilitate wrongdoing;
- Cheat, manipulate ratings, use unauthorized automation, exploit bugs for unfair advantage, or attempt to compromise game integrity;
- Attempt unauthorized access to systems, accounts, or data; scrape or overload the Service; bypass rate limits or security controls;
- Reverse engineer, decompile, or attempt to extract source code from the Service except to the extent permitted by law;
- Misrepresent your identity or affiliation;
- Use the Service for unsolicited advertising or spam;
- Infringe intellectual property or other rights of ChessVC or third parties.
We may investigate suspected violations and cooperate with law enforcement where permitted.
6. User content and license
You retain rights to content you submit (“User Content”), subject to the licenses below. You represent that you have the rights needed to submit User Content.
You grant ChessVC a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for formatting or technical processing), display, and distribute User Content as reasonably necessary to operate, promote, and improve the Service.
You understand that certain profile fields (such as username) may be publicly visible.
7. Intellectual property
The Service, including branding, logos, UI, text, graphics, and underlying software, is owned by ChessVC or our licensors and protected by intellectual property laws. Except for the limited right to use the Service as offered, no rights are granted to you.
8. Ratings, gameplay outcomes, and fairness
Ratings (such as Elo) and outcomes are determined by Service rules and automated systems. We may adjust ratings or results to correct errors, abuse, or technical faults.
9. Optional payments and supporter benefits
Certain features may be offered for voluntary payments (including tips or supporter tiers). Prices, taxes, availability, and descriptions may change. Payments are processed by third-party providers; their terms also apply.
Unless required by applicable law, payments are generally non-refundable once delivered or initiated. If you believe a billing error occurred, contact us via Support promptly.
10. Third-party services
The Service relies on third-party infrastructure (for example authentication providers, databases, payment processors). Their availability and practices may affect the Service.
11. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHESSVC DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHESSVC AND ITS AFFILIATES, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO CHESSVC FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) FIFTY US DOLLARS (USD $50), IF YOU HAVE NOT PAID ANYTHING.
Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the fullest extent permitted by law.
13. Indemnity
You will indemnify and hold harmless ChessVC and its affiliates from third-party claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your User Content, your use of the Service, or your violation of these Terms or applicable law.
14. Suspension and termination
We may suspend or terminate access to the Service at any time for operational, legal, or policy reasons, including violations of these Terms. You may stop using the Service at any time. Provisions intended to survive termination (including intellectual property, disclaimers, limitations of liability, indemnity, and dispute terms) will survive.
15. Changes
We may modify these Terms by posting updated Terms on this page and updating the “Last updated” date. Material changes may include additional notice. Continued use after changes become effective constitutes acceptance unless applicable law requires otherwise.
16. Governing law and disputes
These Terms are governed by applicable law without regard to conflict-of-law principles that would require applying another jurisdiction’s laws. Unless prohibited by applicable law, you agree that exclusive venue for disputes will be in the courts located where ChessVC’s operator is established, and you consent to personal jurisdiction there.
Nothing in these Terms limits rights that cannot legally be waived or limited in your jurisdiction (including statutory consumer rights).
17. Miscellaneous
- Entire agreement. These Terms and the Privacy Policy constitute the entire agreement between you and ChessVC regarding the Service.
- Severability. If any provision is invalid, the remainder remains in effect.
- No waiver. Failure to enforce a provision is not a waiver.
- Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger or sale of assets.
